Sweeps 掃查

1. Market surveillance authorities shall conduct simultaneous coordinated control actions (sweeps) of particular products with digital elements or categories thereof to check compliance with or to detect infringements of this Regulation. Such sweeps may include controls of products with digital elements purchased under cover identities. Where, on the basis of an analysis of the prevailing market trends, consumer complaints or other indications, ENISA observes that certain categories of products with digital elements present a significant cybersecurity risk and may be the subject of sweeps, ENISA shall submit a proposal for a coordinated sweep to the Commission, with a view to its consideration by the relevant market surveillance authorities.

2. Without prejudice to the powers laid down in Regulation (EU) 2019/1020 and where appropriate, on the basis of the technical reports prepared by ENISA pursuant to Article 17(2) and the analysis based on the notifications received pursuant to Article 14(1) and (3), ENISA identifies categories of products with digital elements for which sweeps may be organised. The proposal for a coordinated sweep shall be submitted to the network of administrative cooperation referred to in Regulation (EU) 2019/1020 for its consideration.
