Article 37 Requirements relating to notifying authorities 1. A notifying authority shall be established in such a way that no conflict of interest with conformity assessment bodies occurs.
2. A notifying authority shall be organised and shall function so as to safeguard the objectivity and impartiality of its activities.
3. A notifying authority shall be organised in such a way that each decision relating to notification of a conformity assessment body is taken by competent persons different from those who carried out the assessment. A notifying authority shall not offer or provide any activities that conformity assessment bodies perform or consultancy services on commercial or competitive basis.
5. A notifying authority shall safeguard the confidentiality of the information it obtains.
6. A notifying authority shall have a sufficient number of competent personnel at its disposal for the proper performance of its tasks.
第 37 條 對通報機關之要求
1. 通報機關之設置應使其與合規評鑑機構之間不致產生利益衝突。
2. 通報機關之組織與運作應確保其活動之客觀性與公正性。
3. 通報機關之組織應使有關通報合規評鑑機構之每一決定、皆由執行該評估之人員以外之有資格人員作成。
4. 通報機關不得提供合規評鑑機構執行之活動，亦不得提供商業或競爭性質之諮詢服務。
5. 通報機關應對其取得之資訊保持機密。但仍應就指定機構之相關資訊與執委會、會員國其他通報機關及其他相關國家機關進行交換。
6. 通報機關之評估應有足夠之有資格人員以妥當執行其任務。
