Article 49 Information obligation on notified bodies 1. Notified bodies shall inform the notifying authority of the following: (a) any refusal, restriction, suspension or withdrawal of a certificate; (b) any circumstances affecting the scope of and conditions for notification; (c) any request for information which they have received from market surveillance authorities regarding conformity assessment activities; (d) on request, conformity assessment activities performed within the scope of their notification and any other activity performed, including cross-border activities and subcontracting.
2. Notified bodies shall provide the other bodies notified under this Regulation carrying out similar conformity assessment activities covering the same products with digital elements with relevant information on issues relating to negative and, upon request, positive conformity assessment results.
第 49 條 指定機構之資訊義務
1. 指定機構應將下列事項通知通報機關：拒絕、限制、暫停或撤回 EU 型式檢驗證書或品質保證系統核准、或關於合規評鑑活動之任何重大資訊；影響其通報範圍與條件之情況；其自市場監督機關收到之關於合規評鑑活動之資訊請求；其在通報範圍內所執行之合規評鑑活動及其他活動，包括跨境活動及分包。
2. 指定機構應向其他依本法規通報、執行類似合規評鑑活動且涵蓋相同具數位元素產品之指定機構、提供關於合規評鑑結果負面、若被請求則為正面之相關資訊。
