Article 41 Subsidiaries of and subcontracting by notified bodies 1. Where a notified body subcontracts specific tasks connected with conformity assessment or has recourse to a subsidiary, it shall ensure that the subcontractor or the subsidiary meets the requirements set out in Article 39 and shall inform the notifying authority accordingly.
2. Notified bodies shall take full responsibility for the tasks performed by subcontractors or subsidiaries wherever they are established.
3. Activities may be subcontracted or carried out by a subsidiary only with the agreement of the manufacturer.
4. Notified bodies shall keep at the disposal of the notifying authority the relevant documents concerning the assessment of the qualifications of the subcontractor or the subsidiary and the work carried out by them under this Regulation.
第 41 條 指定機構之子公司及分包
1. 指定機構若將與合規評鑑相關之特定任務分包、或委由子公司處理、應確保該分包商或子公司符合第 39 條之要求、並通知通報機關。
2. 指定機構對分包商或子公司所執行之任務、無論其設立地，承擔完全責任。
3. 任務僅在客戶同意之情形下、方得分包或委由子公司處理。
4. 指定機構應將相關文件保留於通報機關可隨時調閱之狀態，包括分包商或子公司之資格評估及該等實體執行之工作。
